Kansas Funeral Trust Forms

The Kansas Funeral Trust Fund was established in compliance with Kansas Law that became effective on July 1, 1982.  Kansas law pertaining to pre-paid funeral plans is found at K.S.A. 16-301, et seq.  Those statutes provide that a citizen of the State of Kansas establishing a pre-paid funeral plan with a licensed funeral home in Kansas must deposit the payment for such plan in a trust with a bank, trust company or other financial institution qualified to accept such deposits under the Act.  Those funds may be held in a common or co-mingled trust by the financial institution receiving them and are to be paid to the funeral home only when it performs the services stated in the pre-paid funeral service agreement.  The law has many other significant features, all of which have been incorporated in the Irrevocable or Revocable Trust Agreement used in conjunction with the Kansas Funeral Trust Fund.

In order to assist in the administration of all trust funds deposited at the time pre-paid funeral service agreements are executed, the Kansas Funeral Directors Association has created a Trust Agreement for its members with UMB Bank, n.a.  The agreement is known as the Kansas Funeral Trust Fund and the trust will serve as a depository of funds paid to association member Kansas licensed funeral homes that are participants in the Kansas Funeral Trust Fund.  The Trust funds will be co-mingled and invested as a single fund but with a separate account record to be maintained for each pre-paid funeral service agreement established by a citizen.

Changes have been made to all Funeral Trust Agreement forms below.  Please throw away any old forms you may have printed and/or saved on your computer. Please use the new forms for any new trusts or death claims. If current forms are not used your firm will not be in compliance with state law.

Annuity Funded Options

The Annuity Invested Trust options can only be used with Irrevocable Trusts. A minimum initial deposit of $250 is required to open an Annuity Invested Trust Account.

Tax Exempt Funded Options

The Kansas Funeral Trust is no longer offering the Tax Exempt Investment Option. Additional Investment to existing Tax Exempt Trusts will be accepted.
